GundogTV Terms of Use

GundogTV provides a subscription service that allows our members to access entertainment content ("GundogTV content") over the Internet on computers and other devices. These Terms of Use govern your use of our service. As used in these Terms of Use, "GundogTV service", "our service" or "the service" means the personalized digital content service provided by GundogTV for discovering and accessing GundogTV content, including all features and functionalities, recommendations and reviews, our websites, and user interfaces, as well as all content and software associated with our service. References to ‘you’ in these Terms of Use indicate the member who created the GundogTV account and whose payment method is charged.

By accessing our site and services, you agree to comply with the following Terms and Conditions ("T&Cs"). These T&Cs outline the terms of use and govern your relationship with GundogTV Ltd, a company registered in England and Wales.

1. Agreement

By entering our site or creating an account, you accept these T&Cs, which establish a binding agreement between you and GundogTV. GundogTV reserves the right to update these T&Cs periodically. It is your responsibility to check for changes.

2. Membership and Account Use

2.1 Eligibility: You must be 18 years or older to create a GundogTV account. Only one account per household is allowed, and duplicate accounts are prohibited.

2.2 Account Information: You agree to provide true, accurate, and complete information during registration. Keep this information updated at all times. Your membership account must include a valid email address, telephone number, and correct full address. You are responsible for keeping your password confidential and secure.

2.3 Subscription Plans: GundogTV offers various membership plans. Visit the "My Account" page on our website to view plan details and billing cycle. All memberships continue until terminated and are non-transferable.

2.4 Billing: Subscription fees are charged per billing cycle as selected at sign-up. Payments are processed securely via Stripe, which is responsible for all transactions. Fees are non-refundable, and GundogTV is not liable for third-party payment provider actions or omissions.

2.5 Cancellation: You may cancel your membership at any time through the "My Account" page. Your account will close at the end of your current billing period, and no refunds will be issued for partial periods.

3. Service Use

3.1 Personal Use: GundogTV content is for personal, non-commercial use only. Sharing content outside your household is prohibited unless permitted by your plan.

3.2 Prohibited Actions: You agree not to:

• Use robots, spiders, scrapers, or similar methods to access the site or circumvent content protections.

• Reproduce, modify, distribute, display, or perform GundogTV content outside authorized access.

• Attempt to reverse engineer or decompile any software associated with GundogTV.

  Violation of these rules may result in account suspension or termination.

4. Advertising on GundogTV

4.1 Specific Ad Posting Rules

You warrant and agree that you will comply with the following conditions when choosing to advert on GundogTV:

• Any dogs advertised by you must be owned or have been bred yourself.

• To meet PAAGs minimum standards, we reserve the right to refuse any advert(s) that may compromise them.

• We enforce age restrictions on when pets can be rehomed/collected in line with animal welfare guidance. For dogs they cannot be separated from their mother before 8 weeks of age.

• In the case of advertising a litter, the litter must be advertised together and you are required to send us a photo for uploading of the litter together with their mother.

• When uploading an advert, you must disclose the dog’s full breed for transparency with the buyer. If the dog is a crossbreed, it will be advertised in the mixed breed category.

• When registering for an advert, you must state the correct category (Litter, Part-trained, Full Trained or Stud).

• All photos of dogs must be of the actual dog you wish to rehome, and not copied/downloaded pictures of other dogs from the internet.

• GundogTV will not permit adverts that promote or infer that dogs are gifts or presents, e.g. for special holidays like Christmas,

• The images and location stated on your listing is the actual location where the dog is currently and permanently housed.

• We do not allow pregnant bitches or bitches that you think may be pregnant to be advertised.

• It is not permitted to advertise seeking to swap or exchange any dog.

• Each advert you post will remain live on our platform until your membership expires or be given a 4-month lifespan. After expiration of your membership, we will remove all your adverts.

• You are expected to inform us with 7 days of your dog being sold so we can close down the advert.

• At 4 months we will email asking if you still require the advert. If we receive no re-apply, we will remove the advert until such time we receive a response.

• If necessary, you can update your adverts each new membership month.

• You must clearly identify all health and welfare issues associated with any dogs you wish to re-home.

• We do not permit adverts for dogs that offer delivery or courier service. A dog in a litter must be collected at the house where the mother of the litter lives. All dogs for rehoming must be available for viewing at your home or place of business. 

• We do not allow large commercial breeding of dogs, regardless of licensing status.

• We do not allow anyone under the age of 18 to use the website to contact an advertiser. If you are advertising a dog via your GundogTV membership, you must ensure anyone buying your dog is at least 18 years of age.

• We reserve the right to decline any adverts, ban, close or suspend a user's account if we suspect inappropriate behaviour or unethical breeding, which is not limited to the rules above.

If you break any of the above rules, we may end all or any Adverts you have placed with us and close your membership account.

4.2 Specific Ad Posting Rules

In addition to the general ad posting rules you warrant and agree that you will comply with the following conditions when advertising any puppy/dog on GundogTV:

• Dogs must be microchipped from 8 weeks of age.

• If you are selling a litter you must be able to show all puppies to any prospective owner with their mother.

• Only dogs that are working gundogs breeds may be advertised on GundogTV.

• We do not allow sires to be advertised for stud if they are under 12 months of age.

• If the dog you wish to rehome is registered with any governing body, such as the Kennel Club you must state this in your advertisement description and be able to provide all paperwork to verify that registration, if required.

4.3 Breeding and Licences

• If you are advertising dogs for sale and are required to possess a breeding licence from your local council, you must ensure that you

• i) declare you are a Breeder to us,

• ii) send us your licence number and expiration date, and the issuing local authority name.

• If we suspect that you need to be licensed but you have not provided your licence details, we reserve the right to decline your adverts until we receive your licence details.

4.4 Ad Lifespan: Each ad remains active until the membership expires or reaches 4 months, after which GundogTV will verify if the ad is still needed.

4.5 Limitations on Content and Breeds: Only gundog breeds recognized by the UK Kennel Club may be advertised. GundogTV reserves the right to decline ads or terminate accounts violating these conditions.

5. Intellectual Property

5.1 Ownership: All content on GundogTV is the property of GundogTV Ltd or its affiliates. You agree not to copy, imitate, or use GundogTV trademarks or content without permission.

5.2 Content License: By uploading content, you grant GundogTV a royalty-free, worldwide right to use your content for promotional purposes.

6. Disclaimer and Liability

6.1 Service Availability: GundogTV does not guarantee uninterrupted access to the site or its content. Service interruptions may occur, and we disclaim responsibility for data loss or system damage.

6.2 Liability Limitations: GundogTV is not liable for indirect, special, or consequential losses.

7. Privacy and Data Protection

GundogTV is committed to protecting your privacy. Refer to our Privacy and Cookie Policy, which forms part of these T&Cs.

8. Complaints and Disputes

8.1 Contact: For issues or complaints, contact us via the provided contact page. We will review and address complaints reasonably, but GundogTV does not guarantee specific response times.

8.2 Resolution: By using GundogTV, you agree to attempt to resolve disputes directly with us before seeking legal recourse.

9. Miscellaneous

9.1 Jurisdiction: These T&Cs are governed by the laws of England and Wales.

9.2 Modifications: GundogTV may update these T&Cs at any time. Continued use of the service indicates acceptance of the revised terms.
